The department is working with states and territories to develop a code of practice to assist drone operators operate in accordance with local privacy laws and community guidelines.

Privacy

Drone Privacy Guidelines have been developed to assist drone operators operate in accordance with Australian privacy laws and community guidelines.

When flying drones, it is important to respect privacy and we want to make it as easy as possible for everyone to understand safe and considerate drone use that is in line with community expectations. The Guidelines aim to help drone users and community understand privacy laws in relation to drone use.

Public consultation for the Guidelines has closed and the submissions received have been published here.

The department has reviewed and incorporated feedback, where relevant, from the submissions received from the general public and industry stakeholders.

General information for individuals and organisations can be found at the Office of the Australian Information Commissioner. Drone operators should follow the Australian Privacy Principles.

Summary of state and territory advice on privacy laws

Inappropriate drone use could also breach state and territory laws relating to privacy, trespass, harassment, intimidation, nuisance and endangering safety. These can differ between states and territories and may not specifically mention drones. Operators should seek specific legal advice or contact relevant state or territory bodies if they have any concerns or questions about proposed activities.
